The Espinoza & Heskia Abogados team obtained a favorable ruling as part of a pro bono effort aimed at safeguarding the right to rehabilitation and social reintegration of a convicted young mother.
The client was sentenced to serve a custodial penalty for a crime committed several years ago, in a context marked by a long history of problematic drug use and a situation of high social vulnerability. During the execution of her substitute sentence—intensive supervised release—she faced difficulties in maintaining the originally assigned intervention plan due to her addiction.
However, her situation changed profoundly over the last year. Following the birth of her son, she voluntarily entered a rehabilitation program in the city of Rancagua, where she actively participates in a comprehensive process of treatment and psychosocial support aimed at her recovery and strengthening the maternal bond.
In that context, and having been summoned to a hearing where the court could revoke the benefit and order her imprisonment due to the repeated non-compliance with her plan, the firm took on her pro bono representation, requesting to maintain the intensive supervised release.
The court accepted the arguments presented, recognizing the client’s progress and valuing the importance of continuing the current treatment, as well as the bond with her newborn son. In this way, a response focused on social reintegration was prioritized, consistent with international human rights standards that recommend alternatives to imprisonment for women with caregiving responsibilities.
